Terms & Conditions
Welcome to Welcome to MUUSE (“we,” “our,” or “us”). These Terms and Conditions (the “Agreement” or “Terms”) govern your access to and use of our website and services, including participation in our studio classes, workshops, events, and memberships (collectively, the “Services”). MUUSE is operated by MUUSE, LLC, an Arizona limited liability company located at 3844 N 32nd Street, Suite 101, Phoenix, AZ 85018.
By accessing or using www.muuseworld.co (the “Site”) or attending any of our Services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.
These Terms incorporate our Privacy Policy and our Liability Waiver & Release, which you must accept before participating in any class or event. They also work alongside any Membership Agreement or Class Pack Agreement you sign. If these Terms conflict with your Membership Agreement or Class Pack Agreement, that agreement controls for your membership or class pack.
1. Eligibility
You must be at least 18 years old to create an account, purchase a membership, or use our Services independently. Clients ages 16 and 17 may purchase class packs and attend classes only if a parent or legal guardian co-signs their Class Pack Agreement, signs our Liability Waiver & Release in person at the studio, and takes the same class alongside them every time. A parent or guardian who is on site but not taking the class does not satisfy this requirement, and the minor will not be permitted to participate. Memberships are available to adults only. We do not permit participants under the age of 16, and we may deny participation to any minor.
2. Accounts
You may need to create a MUUSE account to book classes or purchase memberships. You must provide accurate and complete information, keep your password secure, and never use another person’s account without permission. You are responsible for all activity on your account and must notify us immediately of any unauthorized use.
Duplicate accounts (accounts sharing the same name, email address, phone number, or physical address) are prohibited, and we may merge them without notice. If a duplicate account was used to obtain promotions or offers you would not otherwise have been eligible for, we may charge you the full value of the services received.
3. Bookings, Cancellations and Studio Policies
Cancellations. All clients must cancel at least 12 hours before the scheduled start of class. Cancellations made before the 12-hour window carry no fee and no loss of credit. Members who cancel within 12 hours are charged a $12 late cancellation fee, and members who do not attend a reserved class without canceling are charged a $15 no-show fee. Clients with class packs forfeit the class credit for any late cancellation or no-show. Switching to a different class time within the 12-hour window is treated as a late cancellation. You may cancel through our booking app or website, and you authorize us to charge any fees to your payment method on file.
Waivers of Fees. If you contact us before class with a legitimate emergency, MUUSE may, in its sole discretion, waive a fee or restore a credit. Any waiver is a one-time courtesy and does not create a right to future waivers. We may decline repeated requests, and verbal requests for additional waivers will not be honored.
Arrival and Late Entry. Reformer classes have a 5-minute rolling grace period: you may enter up to 5 minutes after the scheduled start time, and not later. Mat classes begin promptly 3 minutes after the scheduled start time, and no one will be admitted once class has begun, without exception. A client who is not admitted because they arrived after the grace period is treated as a no-show, and the spot may be released to a waitlisted client.
Attendance. Please do not leave class early unless you are unwell. Do not enter a studio while class is in progress.
Injury, Illness, and Right to Decline. If you are recovering from an injury or illness, or are pregnant, tell your instructor before class begins. Please do not attend if you are sick or contagious. MUUSE does not screen or evaluate your fitness. However, MUUSE may decline or end your participation in a class if, based on what you tell us or what we observe, we reasonably believe that continuing would be unsafe for you or others, and we may ask for a physician’s note before you return. We make this decision based on an individualized assessment of safety and not on any protected characteristic.
Studio Rules. Phones and other personal devices must stay out of the class rooms during class. Glass water bottles and other glass containers are not permitted in either room. Grip socks are required for all reformer classes and are not required for mat classes. AI-enabled or surveillance-capable eyewear, including smart glasses such as Meta Ray-Ban glasses, may not be worn anywhere on MUUSE premises, whether or not you are taking class. A violation will result in immediate termination of your membership or access, and unused class credits are forfeited, subject to any rights stated in your Membership Agreement or Class Pack Agreement or required by law. Use equipment only as directed, and do not tamper with equipment, thermostats, lighting, or sound controls. MUUSE supplies mats, towels, props, and equipment, and you may not bring outside equipment into the class rooms without our prior written approval. Do not consume alcohol before participating in any class. Lockers and cubbies are available for day use only. Items left in the lost and found for 30 days or more, and items left overnight, may be donated to charity without notice.
Personal Belongings. All personal belongings beyond what you minimally need for class must be stowed in the locker room during class and may not be brought into the class rooms. MUUSE is not responsible for lost, stolen, or damaged belongings. You assume all risk of loss for any items you bring into the studio.
Conduct. MUUSE is a place of wellness and community. Harassment of any kind, whether verbal, physical, or visual, will not be tolerated. Please treat MUUSE’s ownership, staff, other clients, partners, neighboring businesses and their patrons, and the studio facilities and equipment with respect.
Parking. Our parking lot is shared with other tenants of the building and is available on a first-come, first-served basis in unmarked spaces only. Do not park in marked, reserved, or staff-designated spaces. Free street parking is available nearby, including along E Fairmont Ave. MUUSE is not responsible for any theft, damage, towing, citations, or other loss relating to any vehicle parked in our lot or on the street.
Right of Refusal and Removal. MUUSE reserves the right to refuse service, deny entry, or remove any client from the studio for safety concerns, policy violations, disruptive behavior, or failure to follow instructor direction. Removal does not entitle you to a refund, credit, or extension, except as stated in your Membership Agreement or Class Pack Agreement or required by law. Repeated or serious violations may result in suspension or termination of studio access.
4. Purchases, Memberships and Class Packs
General. Except as stated in your Membership Agreement or Class Pack Agreement, or as required by Arizona law, all purchases are final and non-refundable. Your agreement may give you the right to cancel within three calendar days of signing, as well as special cancellation rights, and nothing in these Terms waives any right you have under applicable law. Prices and offerings may change at any time, but changes will not affect class packs you have already purchased or the locked rate of an active membership.
Memberships. Memberships are governed by your Membership Agreement, which states your tier, price, and minimum commitment. After the minimum commitment, your membership continues month to month at your locked rate until you cancel. You may not cancel during the minimum commitment except as your agreement allows, and you remain responsible for dues through the minimum commitment. After the minimum commitment, you may cancel at any time through the Mariana Tek app, our website, or as your agreement describes, and cancellation takes effect at the end of the current billing cycle. Dues already charged are not refunded. Memberships are personal to you and may not be sold, gifted, shared, or transferred. If you cancel and later return, you will be enrolled at the then-current rate for your tier.
Membership Freeze. Members may freeze their membership once per calendar year for a minimum of 14 days and a maximum of 60 days. Freeze requests must be submitted through the Mariana Tek app and cannot be applied retroactively. Billing is suspended during a freeze, and your billing date and membership term are extended by the number of days frozen.
Class Packs. Class packs are one-time purchases and do not renew. Credits are room-specific: reformer credits may be used only in the reformer room, and mat credits only in the mat room. Credits cannot be transferred between rooms and may not be applied to private sessions unless we say so in writing. Credits expire as stated in your Class Pack Agreement, and expired credits are forfeited with no refund, credit, or rollover, except as stated in your agreement or required by law. Once credits are attached to an account, they may be used only by the account holder.
Guests. Where a guest allowance applies, or where you book a class for a guest using your credit, the guest must create their own MUUSE account, check in at the studio, and sign MUUSE’s then-current Liability Waiver & Release and agree to studio policies before participating. Guests may not use your account or credentials, and you are responsible for your guest’s compliance with MUUSE policies.
Discounts and Promotions. Certain packages and codes are available to first-time clients only, limited to one first-time offer per person. Codes may not be combined, and referral codes may not be used to redeem multiple complimentary classes. Misuse of promotions, including through duplicate accounts, may result in charges for the full value of services received and cancellation of your account.
Retail Items. Unopened, unused retail items may be returned within 7 days of purchase for a refund to the original form of payment. All other retail sales are final, and no returns, exchanges, or credits are available after 7 days.
Gift Cards. Gift cards are non-refundable, cannot be exchanged for cash, and will not be replaced if lost or stolen.
Waitlist. A waitlist is available for every class unless MUUSE decides otherwise. The waitlist closes 1 hour before class begins. If you join a waitlist, you are subject to the same policies as a confirmed booking, including the 12-hour late cancellation window and its fees or credit forfeiture.
Payment Authorization and Failed Payments. By making a purchase, you authorize MUUSE to charge your payment method on file, through Stripe as processed by Mariana Tek, for dues, purchases, and any fees you incur. If a charge fails, we will try to notify you by email, and we may suspend your access until payment is resolved and terminate your membership for non-payment after reasonable notice.
Chargebacks. You agree not to initiate a chargeback or payment dispute without first contacting us to resolve the issue. A chargeback made in violation of this section is a material breach of these Terms and may result in suspension or termination of your access. We may recover any fees or costs incurred and share these Terms and your agreements with your financial institution. This section survives termination.
5. Health and Safety; Assumption of Risk
Participation in any movement or fitness activity involves risk of injury, including falls, equipment-related injuries, and aggravation of existing conditions. By using our Services, you certify that, to the best of your knowledge, you are physically able to participate. You agree to tell your instructor about any injury, pregnancy, or health condition that may affect your safety, and to modify or stop any exercise that causes pain or discomfort. MUUSE encourages, but does not require, you to consult a physician before participating.
MUUSE instructors are movement professionals, not medical providers, and nothing in our Services is medical advice. MUUSE does not screen or evaluate your physical fitness.
Before your first class, you must accept our Liability Waiver & Release, which forms part of these Terms. To the fullest extent permitted by Arizona law, you voluntarily assume all risks of participation and release MUUSE, LLC and the other Released Parties as set out in that Waiver. The release does not apply to gross negligence or intentional misconduct.
In an emergency, you authorize our staff to call 911 and seek medical care on your behalf, even if you refuse assistance at the time, and you accept financial responsibility for related costs.
6. Photo, Video and Social Media
Optional Media Consent. MUUSE will use your image, likeness, or voice in photos, video, or other content only if you have given optional consent in your agreement or waiver. Consent is optional, and declining it does not affect your membership or access. You may revoke consent at any time by written notice to hello@muuseworld.co. Revocation applies going forward, and MUUSE is not required to remove content published before it receives your notice.
No Recording in Class. Clients may not film, record, or photograph in either class room while class is in session. Clients found filming, or posting in-class content online, risk losing their membership or class credits and may be barred from the studio. Egregious violations, including unauthorized recordings of other clients, may also result in legal action.
Instructor Filming. Instructors may film within the class rooms while teaching, provided that no identifiable client faces are captured, no tripods are used, and filming does not interfere with the instructor’s duties or any client’s safety.
Prohibited Content. You may not post content about MUUSE, its ownership, staff, or clients that is false, defamatory, or harassing, or that discloses another person’s private information. Nothing in these Terms restricts you from posting honest, good-faith reviews or opinions about your experience.
7. Mobile Services and Communications
Our Services may include booking, messaging, and account features available through your mobile phone. We do not charge for these, but your carrier’s message and data rates may apply. By providing your phone number or email, you agree that we may contact you about your account, bookings, and studio updates by email, SMS, or other electronic means. You may opt out of promotional messages at any time by following the unsubscribe instructions, though we may still send transactional messages about your account and bookings.
8. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO BRING A LAWSUIT IN COURT.
Informal Resolution. We aim to resolve concerns quickly and respectfully. Before starting any formal proceeding, the party raising a dispute must send the other written notice describing the dispute and the relief requested, and the parties will try in good faith to resolve it for 30 days. You can reach us at hello@muuseworld.co .
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, your membership or purchases, or your use of the studio or Services that is not resolved informally will be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Maricopa County, Arizona, and the Federal Arbitration Act governs this Section 8. The arbitrator’s award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Small Claims. Either party may instead bring an individual claim in small claims court or justice court in Maricopa County, Arizona, if the claim is within that court’s jurisdiction.
Class Action Waiver. Each party waives any right to bring or participate in a class action, collective action, or representative proceeding. All claims must be brought in a party’s individual capacity only.
Costs. Arbitration fees and costs will be allocated as provided in the AAA Consumer Arbitration Rules.
Jury Trial Waiver. YOU AND MUUSE EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL FOR ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE STUDIO.
Exceptions. Either party may seek injunctive or other equitable relief in court for infringement or threatened infringement of intellectual property rights.
9. Intellectual Property
All content, branding, names, logos, designs, photography, and materials on www.muuseworld.co and in our studio are owned by or licensed to MUUSE, LLC. Unauthorized use, reproduction, or distribution is strictly prohibited.
10. Termination
You may cancel your membership as described in Section 4 and your Membership Agreement. MUUSE may suspend or terminate your access to the Site, your account, or your membership, or permanently ban you from the studio, for any of the following: violating any studio policy or these Terms; disrespectful, abusive, or harassing conduct; violating the recording rules in Section 6; wearing AI-enabled or surveillance-capable eyewear on our premises; non-payment after reasonable notice; or any conduct that, in our reasonable judgment, threatens the safety, wellbeing, or experience of others. If we terminate for one of these reasons, your access ends immediately, unused class credits are forfeited, and no refund is owed, except as stated in your agreement or required by law.
MUUSE may also end your membership or access for any reason or no reason by written notice. In that case, we will refund the prorated unused portion of any prepaid dues, or the price of your unused, unexpired class credits, within 30 days, and any fees you incurred before the effective date remain due. We will not terminate your access on any basis prohibited by law. Provisions that by their nature should survive termination will survive, including those on ownership, liability, release, indemnity, payment obligations, and dispute resolution.
11. Third-Party Sites
Our Site may link to third-party sites and services that we do not own or control. We are not responsible for their content, privacy policies, or practices, and we encourage you to review their terms before using them.
12. Privacy
MUUSE, LLC complies with applicable privacy laws. We collect only the personal information needed to provide our Services, and we do not sell your personal information. You may ask us to access, correct, or delete the personal information we hold about you by emailing hello@muuseworld.co. Our Privacy Policy, which is part of these Terms, explains what we collect, how we use it, and your choices.
13. Modifications to These Terms
We may update these Terms and our studio policies from time to time. For changes that affect an active membership, we will give at least 30 days’ written notice by email or through the Mariana Tek app, and your continued use after the notice period ends means you accept the change. If you do not accept it, you may cancel before it takes effect, and if a change materially and adversely affects you, you may cancel before it takes effect without regard to any remaining minimum commitment. No update will increase the price, reduce the number of credits, or shorten the expiration period of a class pack you have already purchased, or change a member’s locked rate during an active membership. Other updates are effective upon posting to our Site or in Mariana Tek.
14. General
These Terms, together with our Privacy Policy, our Liability Waiver & Release, and any Membership Agreement or Class Pack Agreement you sign, are the entire agreement between you and MUUSE, LLC regarding the Services. If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable or, if it cannot be modified, severed, and the remaining provisions stay in full effect. A waiver of any provision is effective only if in writing, and our failure to enforce a provision on one occasion does not waive our right to enforce it later. You may not assign these Terms. We may assign them to a successor operator of the studio, and your rights and defenses under these Terms will be preserved against any such successor. You may accept these Terms and sign agreements electronically, and an electronic signature is as valid and binding as a handwritten signature.
15. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles, except that the Federal Arbitration Act governs Section 8. Subject to Section 8, you agree that any court proceeding will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
